What is an FGM Protection Order?

A Female Genital Mutilation (FGM) Protection Order is a court order which protects victims or potential victims.

It is made by the court and puts in place requirements and restrictions to keep the person safe.

The type of things an order might put in place include:

  • to order that a person hands over his or her passport or any other travel documents and/or the passport of the girl/woman to be protected. This would prevent them from taking the girl or woman at risk abroad with the purpose of committing FGM
  • to order family members or other named individuals not to aid, abet, counsel, procure, encourage or assist another person to attempt to commit, commit or conspire to commit an FGM offence.

Who can make an application for an FGM Order?

FGM protection orders applications are made through the court and can be made by :

  • the girl or women to be protected 
  • a person or organisation appointed by the Lord Chancellor, known as a Relevant Third Party (RTP). Only local authorities have been classified as a Relevant Third Party
  • any other person with the permission of the court (for example, the police, a support service, a healthcare professional, a teacher, a friend or family member).

What happens if the order is ignored?

It is a criminal offence to ignore (breach) any part of a FGM Protection Order. Disobeying an FGM Protection Order can result in a sentence of up to 5 years in prison.  

A breach could be dealt with as a ‘contempt of court’, which carries a maximum sentence of 2 years in prison.
